Terms & Conditions

GUARANTEE:  All merchandise manufactured by Showball is unconditionally guaranteed to be free from defects of material and workmanship. Any merchandise found to be defective will be replaced by Showball. Showball makes no other warranties, expressed or implied. Showball does not assign determination of defective materials or workmanship to anyone other than itself. If factory deems merchandise as defective, return the merchandise for replacement or credit.

 

RETURNS:  All claims must be made within 5 days of receipt of merchandise. Returns must be authorized by the factory, any returns not authorized will be refused or returned to sender. No returns will be accepted for imprinted or special order merchandise unless it is determined to be defective by the factory. All work is generally considered custom and returns for reasons other than workmanship or defects are not acceptable. No replacement or credit will be issued for merchandise which is unavailable for return to the factory.

 

GOVERNING LAW:  By placing a purchase order with Showball you agree that all transactions shall be governed and construed according to the laws of the State of Georgia. Furthermore, you agree that all disputes shall be settled in Cobb County, Georgia.

 

TERMS:  All accounts require a 50% advance payment. Checks and money orders are acceptable. Net due day of  shipment. Past due invoices are subject to a 1.5% per month or maximum allowed by law finance charge. Production of merchandise will not begin until prepayment is received and/or account is current. In some instances, production will not begin until prepayment has cleared.

 

CHANGES/CANCELLATIONS:  All orders are considered firm. Any change other than quantity, to the order once in production will be billed for any work done, plus any additional work required by the change. Changes in quantity can be made prior to the start of production. If a change in quantity occurs after the completion of any portion of production, the change will be treated as a separate and billed accordingly. Any change made after the start of production will delay shipping. If a cancellation is necessary all costs associated with work performed to date of cancellation will be invoiced. Cancellations must be in writing and acknowledged by Showball.

 

SAMPLES:  A random sample for promotional products can be provided free of charge. If an exact color combination or photographic image is needed and is not available as a random sample it is considered a spec sample. Spec samples are $50. plus a die charge of $44(net). Samples are shipped to the distributor. We do not drop ship samples. If samples are to be shipped other than U.S. Mail, you will be billed for the shipping cost. We do not provide free samples of  helmets. These samples will be billed at the regular catalog price.

 

ORDERS:  Phone orders are not accepted due to the potential for error. All orders are to be faxed e-mailed or placed online. Orders are not put into production unless order is complete. Orders are considered complete with a correct purchase order, complete shipping address(es), camera ready artwork, photographic images and any artwork approvals if required. In hand dates must be clearly stated on purchase order and fall within factory production schedule.

 

SHIPPING:  F.O.B. Warehouse in Georgia. Shipping is available via UPS, Federal Express or USPS. If shipping mode is not specified, Showball will ship, at our discretion, the least expensive way to meet in hand date. If you want your package(s) insured, please indicate that on your order. Showball is not responsible for any freight arrangements made by distributor. Once shipment has left our dock, title is transferred to recipient. Showball is not responsible for delays or damages by carrier. The distributor must make all claims directly to carrier within 15 days of shipment. Split shipments are $5.00(net) per destination. For C.O.D. shipments add $5.00(net) per shipment, plus all carrier fees for C.O.D. shipping. Freight quotes provided by Showball are estimates that are subject to change at time of shipment.

 

PACKAGING:  All products are packaged bulk. Special packaging is available at an additional charge. Call for details.

 

PRICING:  Prices are per product color and design. All prices are subject to change without prior notice. Call for quote for quantities not listed in online catalog.

 

MINIMUMS:  See price lists.

 

PRODUCTION TIME:  Production starts when order is complete and art, if required, are approved for production. Production time is usually less than 3 weeks, depending on quantity. However, from the beginning of July to the end of December production time could be longer. Call for production schedule. Depending on the season, rush orders are accepted if the production schedule allows. Rush orders must be approved by factory before sending order. Production time non-custom orders with stock photographic images could be shipped within 7-10 days, depending on quantity.

 

OVER/UNDER RUNS: Showball ships and bills exact quantities ordered.

 

ARTWORK:  Black on white, spot color-separated artwork, camera-ready is required. If artwork is not camera ready, typesetting and/or art charges will apply. Four color process art is not acceptable. All images submitted are printed as is unless otherwise specified. It is your responsibility to have all images proofed and adjusted to your satisfaction before submission. All artwork is to be supplied at highest possible resolution. Faxed artwork is  not acceptable. Low resolution or jagged art will not look better when printed.

 

PHOTOGRAPHIC IMAGES:  Full-color or black and white images can be used. We accept most electronic media options including e-mail. Disks returned upon request. Please use highest resolution available to you. Slides, negatives and actual photographic prints and reproductions can be used. Image quality is based on actual submission. 

 

TYPESETTING CHARGES:  $50.00 net/hour, quarter hour minimum. Price includes a faxed paper proof of typeset art.

 

ART CLEAN-UP CHARGE:  $60.00 net/hour, half hour minimum. Price includes a faxed paper proof of art.

 

HALFTONES:  55 line screen at 100%, with 25%-75% shading.

 

COPY CHANGE:  $20.00 net +Die Charge when applicable.

 

INK COLOR CHANGE:  $20.00 net.

 

PAPER PROOFS:  $10.00 net for faxed paper proofs on customer sent art. A paper proof will be sent on all typeset, art clean-up, corrected or created art. Art and/or typesetting charges will apply. Showball is not responsible for any errors on approved paper proofs.

 

COLOR MATCH:  Exact color match is used when available. Otherwise colors will be produced to most closely match the color requested.

 

ELECTRONIC ART:  Electronic art must be black only, color separated art-work.  We accept electronic art via CD ROM, Flash Drive, Zip disk and email. Disks can be PC or Mac formatted. Disk will only be returned on request.  Our e-mail address is photos@showball.com.  Showball can accept files created with or editable by Corel Draw, Adobe illustrator, Adobe Photoshop, PrintShop or QuarkXPress.  If the artwork is not available in these formats, factory can also accept artwork in TIFF, EPS or PDF file formats.  File compression is not recommended.  Always include a hard copy of artwork with order, if artwork is e-mailed please fax a hard copy.

 

TRADEMARKS:  The names, artwork, designs, logos and trademarks or similar reproduced throughout our materials are solely intended to show the type and quality of imprinted products available. It does not imply a product/service endorsement by Showball, nor does it imply an endorsement of Showball by the respective owners of the marks.  By placing an order with Showball, you represent and warrant that you have the right to order, purchase and distribute merchandise containing the likeness, names, artwork design, logos, trademarks or similar identified in your order.  The distributor also agrees to indemnify, defend and hold harmless Showball Properties and its parent company, from and against all claims, liabilities and expenses (including attorney fees) arising out of or related to an actual or alleged infringement or misappropriation of any trademark, copyright or any other proprietary right of such merchandise.  This provision will continue to remain in effect after the delivery of your order.  All trademarks are the property of their respective owners.
